Analiza ryzyka naruszenia praw osób, których dane dotyczą - aspekty prawne
Abstract
W niniejszej pracy omówione zostały aspekty prawne analizy ryzyka związanego z naruszeniem praw osób, których dane dotyczą. Zawarte w niej rozważania mają na celu ocenę standardów ochrony jednostki, w tym w szczególności możliwości zaistnienia ryzyka w związku z realizacją przez podmioty danych i administratorów (odpowiednio także procesorów) uprawnień i obowiązków nadanych im przez prawodawcę unijnego na podstawie przepisów ogólnego rozporządzenia o ochronie danych osobowych. Omawiane w pracy zagadnienia pozwalają na wykazanie wpływu koncepcji podejścia opartego na ryzyku na zmienność poziomu ryzyka naruszenia praw osób, których dane dotyczą. W rozprawie kolejno prezentowane są poszczególne prawa, przewidziane przez prawodawcę unijnego, w oparciu o klasyfikację praw na uprawnienia informacyjne, korekcyjne, zakazowe i inne. Przyjęta klasyfikacja umożliwiła przeprowadzenie badania potencjalnych ryzyk charakterystycznych dla poszczególnych grup praw. Analizie zostały poddane okoliczności powodujące powstanie ryzyka, przesłanki do przeprowadzenia analizy ryzyka, a także prawa i wolności mogące podlegać naruszeniu. Wnioski wyciągnięte z przeprowadzonego badania pozwoliły autorowi na sformułowanie postulatów de lege ferenda.
This dissertation contains a review of the legal aspects of a risk analysis relating to the infringement of the personal rights of data subjects. The aim of the legal analysis performed in this dissertation is to evaluate the standards of data protection security, including an analysis of the possibility of the occurrence of risk relating to data subjects and controllers (accordingly, by processors) exercising the rights and obligations granted to them by the EU legislator on the basis of the provisions of the general data protection regulation. The problems discussed in this dissertation allow for a presentation of the impact of the risk-based approach on the variability of the level of risk of the infringement of data subjects' personal rights. The author decided to use a classification of rights, i.e. informative, corrective, prohibitive and other rights for the purpose of the analysis of the specific rights granted by the EU legislator. Such classification enabled the author to examine the potential risks typical of each group of rights. The following aspects have been analysed in this dissertation: circumstances triggering the risk occurrence, conditions for performing a risk analysis, and rights and liberties that may be subject to infringement. The conclusions made on the basis of the analysis helped the author to develop de lege ferenda postulates.
