Reforma terminów przedawnienia w prawie prywatnym

Artykuł przedstawia problematykę związaną z dokonaną z dniem 9 lipca 2018 r. nowelizacją Kodeksu cywilnego w zakresie skrócenia terminów przedawnienia. Na jej podstawie dotychczasowy podstawowy termin przedawnienia wynoszący 10 lat zastąpiony został terminem 6-letnim. Wzmocniono również ochronę konsumenta poprzez wprowadzenie obowiązku badania przez sąd z urzędu terminu przedawnienia roszczenia przeciwko konsumentowi. Dokonana nowelizacja działa w sposób retroaktywny, a szczegóły jej obowiązywania reguluje jej art. 5. The article presents the problems related to the amendment of the Civil Code made on 9th July 2018 in the field of limitation periods. On this basis, the current basic limitation period of 10 years was replaced by a 6-year period. Consumer protection was also strengthened by introducing the duty of the court to examine ex officio the period of limitation of the claim against the consumer. The amended act operates in a retroactive way, and the details of its validity are governed by its art. 5.
